Please read these Terms of Service carefully before using Work Whale (“the Platform”), operated by Work Whale (“we”, “us”, “our”) at workwhale.ph. By registering an account or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Work Whale is an online job marketplace connecting employers with remote workers, primarily based in the Philippines. The Platform facilitates job posting, candidate discovery, application management, interview scheduling, invoicing, and worker reviews. The Platform is provided on an “as is” basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time without liability to you.
You must be at least 18 years old to use the Platform. By registering, you agree to provide accurate and truthful information and to keep your account details up to date. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.
Each account is for individual use only. You may not share, transfer, sell, or allow others to access your account. Employers may only use the Platform to hire on behalf of their own company — posting jobs on behalf of third-party clients is not permitted.
All job posts on Work Whale must represent genuine, paid employment or contracting opportunities. The following are not permitted:
All job posts are subject to review and approval. We reserve the right to reject, edit, or remove any listing at our sole discretion. Basic plan listings are reviewed within 48 hours; Plus and Premium plan listings are approved instantly.
Certain features of the Platform require a paid subscription. Prices are displayed in US Dollars and billed on a monthly recurring basis via Stripe. By subscribing, you authorise us to charge your payment method each billing period until you cancel. You may cancel at any time; access to paid features continues until the end of the current billing period.

Downgrading your plan may result in active job listings or features being paused until they fall within your new plan’s limits. We reserve the right to change pricing at any time with advance notice. Price changes will not affect your current billing period.
Work Whale offers AI-assisted tools including cover letter generation, skill-match scoring, job description writing, resume parsing, and candidate scoring. These features are powered by OpenAI’s API. By using these features, you acknowledge that:
Employers on Plus and Premium plans may add custom screening questions to their job listings. Workers applying to those jobs must answer the questions as part of their application. Employers agree not to use screening questions to collect sensitive personal information (such as medical data or financial details) beyond what is reasonably necessary to evaluate job suitability.
Employers may leave reviews for workers following a completed engagement. Reviews must be honest, accurate, and based on genuine experience. The following are not permitted:

Workers may use the Platform to create and send invoices to employers they are engaged with. Work Whale provides the invoicing tool as a convenience feature only. We are not a party to any financial transaction between workers and employers, and we are not responsible for payment disputes, non-payment, or any financial disagreements arising from invoices issued through the Platform.
The Platform provides a direct messaging system for employers and workers to communicate. You agree not to use the messaging system to:
Messaging access is limited by your subscription plan. Basic plan users cannot initiate messages. Plus plan users may contact up to 100 workers per month; Premium plan users up to 500.
Employers may schedule interview meetings that create Google Calendar events with Google Meet video conference links. By using this feature, you agree to the following:
Work Whale displays job listings sourced from third-party job boards to supplement internally posted jobs. These listings are provided for informational purposes only. Work Whale does not endorse, verify, or take responsibility for external listings or the hiring processes of third-party employers. By clicking an external listing, you are directed to a third-party website and that site’s terms and conditions apply.
All content, trademarks, logos, and technology on the Platform are owned by or licensed to Work Whale. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent. You retain ownership of content you create and upload (such as your profile, resume, and portfolio), but grant us a non-exclusive licence to display it on the Platform for the purpose of operating the service.
We may suspend or terminate your account at any time for breach of these Terms, fraudulent activity, or for any other reason at our discretion. Upon termination, your right to access the Platform ceases immediately. Active subscriptions will not be refunded upon termination for cause.
The Platform is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure access to the Platform, nor do we guarantee that any job listing will result in a hire or that any worker profile will attract applications.
To the fullest extent permitted by applicable law, Work Whale shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform — including but not limited to loss of earnings, loss of data, or failed hires — even if we have been advised of the possibility of such damages. Our aggregate liability to you shall not exceed the total amounts paid by you to Work Whale in the twelve months preceding the claim.
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Philippines.
We may update these Terms from time to time to reflect changes in the Platform, applicable law, or our business practices. We will notify registered users of material changes by email. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
