Please read these Terms of Service carefully. They contain important information about your rights and obligations when accessing and using Work Whale (“the Platform”), operated by Work Whale (“we”, “us”, “our”). By registering or using the Platform, you agree to be bound by these terms.
Work Whale is an online job marketplace connecting employers with remote workers, primarily based in the Philippines. The Platform is provided on an “as is” basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time without liability to you.
You must be at least 18 years old to use the Platform. By registering, you agree to provide accurate and truthful information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your password and all activity under your account.
Each account is for individual use only. You may not share, transfer, or allow others to access your account. Employers may only use the Platform to hire for their own company — use on behalf of a third-party client is not permitted.
All job posts on Work Whale must represent genuine, paid employment opportunities. The following are not permitted:
All job posts are subject to review. We reserve the right to reject or remove any listing at our sole discretion.
Certain features of the Platform require a paid subscription. Prices are displayed in US Dollars. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. You may cancel your subscription at any time; access continues until the end of the current billing period.
We reserve the right to change pricing at any time. Changes will be communicated in advance and will not affect your current billing period.
The Platform allows employers to schedule interview meetings that create Google Calendar events with Google Meet video conference links. By using this feature, you agree to the following:
All content, trademarks, logos, and technology on the Platform are owned by or licensed to Work Whale. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
We may suspend or terminate your account at any time for breach of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately.
The Platform is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure access to the Platform.
To the fullest extent permitted by law, Work Whale shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, even if we have been advised of the possibility of such damages. Our aggregate liability shall not exceed the amounts paid by you in the twelve months preceding the claim.
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Philippines.
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will notify registered users of material changes by email.
